The Platform is owned by Umika's Collections, a proprietorship/company with its principal place of business at E154 Raheja Navodya Gurugram Haryana -122505 (hereinafter referred to as the "Platform Owner," "we," "us," or "our").

Please read these Terms and Conditions ("Terms") carefully. By accessing, browsing, or otherwise using the Platform, you shall be contracting with the Platform Owner, and these Terms (including the policies incorporated herein) constitute your binding obligations.
1. General Conditions and User Responsibilities
1.1 Definitions and Agreement
For the purpose of these Terms, wherever the context so requires, "you," "your," or "user" shall mean any natural or legal person who has agreed to become a buyer/user on the Platform.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS, SO PLEASE READ THEM CAREFULLY BEFORE PROCEEDING.
1.2 Policies Incorporated by Reference
The following policies are incorporated herein by reference and form part of your agreement:
Privacy Policy: Governs the processing of all personal data collected from you.
Refund and Cancellation Policy: Explicitly confirms that ALL SALES ARE FINAL and sets out the strictly limited process for replacement claims concerning damaged or incorrect items.
1.3 Eligibility and Account Information
By placing an order, you warrant that you are at least eighteen (18) years old and legally capable of entering into binding contracts. To access and use the services, you agree to provide true, accurate, and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your account.
1.4 Usage Restrictions
You agree not to use the Platform and/or Services for any purpose that is unlawful, illegal, or forbidden by these Terms, or Indian or local laws that might apply to you.
2. Products, Pricing, and Orders
2.1 Product Description and Availability
We strive for accuracy, but due to the handcrafted nature of our jewelry, we cannot guarantee that the color, clarity, or specifications will be entirely accurate as displayed on your monitor. All weights and measurements are approximate. All products are subject to availability.
2.2 Pricing and Payment Terms
All prices are listed in Indian Rupees (INR) and are subject to change without notice. The price charged will be the price in effect at the time the order is placed. You agree to provide current, complete, and accurate purchase and account information for all transactions processed by third-party payment processors.
2.3 Custom Orders and Deposits
For any custom or made-to-order jewelry, a non-refundable deposit will be required before work begins. Custom orders are final and cannot be cancelled or altered after the design is finalized and work has commenced.
2.4 Errors and Omissions
In the event a product is listed at an incorrect price due to typographical error, we shall have the right to refuse or cancel any orders. If payment has already been made, we will issue a credit to your account for the incorrect price amount.
3. Shipping, Risk of Loss, and Title
3.1 Shipping Terms
Shipping terms, including costs, estimated delivery times, and security requirements, are governed by our separate Shipping Policy.
3.2 Risk of Loss
The risk of loss and title for all products pass to you upon our delivery to the shipping carrier. We are not responsible for packages that are lost, damaged, or stolen after the carrier has successfully delivered the items to the address provided (verified by tracking and/or signature confirmation).
4. Intellectual Property Rights
4.1 Ownership and License
The contents of the Platform (including design, graphics, text, logos, and product photographs) are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. You are granted a limited, non-sublicensable license to use the Site and its Content for personal, non-commercial use only.
4.2 Custom Designs
Any custom jewelry design created by Umika's Collections for you remains our intellectual property, including the right to photograph and display the design, unless otherwise agreed upon in a separate written agreement.
5. Disclaimer of Warranties
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials offered on this Platform or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Your use of our Services and the Platform is solely and entirely at your own risk and discretion, for which we shall not be liable to you in any manner.
6. Limitation of Liability and Force Majeure
6.1 Limitation of Liability
In no event will the Platform Owner be liable for any indirect, consequential, incidental, special, or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of data, or loss of other economic interests, whether in contract, negligence, tort, or otherwise, arising from the use of or inability to use the Services.
Notwithstanding anything contained in these Terms, the maximum liability of the Platform Owner for any claim related to the purchase of products shall not exceed the amount paid by you for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100), whichever is less.
6.2 Force Majeure
The parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event (an event beyond the reasonable control of the party, such as natural disaster, war, or governmental actions).
7. Indemnification
You shall indemnify and hold harmless the Platform Owner, its affiliates, and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of these Terms, Privacy Policy, and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
8. Governing Law and Dispute Resolution
8.1 Governing Law
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
8.2 Jurisdiction
You agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be exclusively brought in the courts located in Gurgaon, Haryana, India.
9. Changes to Terms
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
